Christmas and the holidays are an exciting and busy time but with all the joys of the holiday season come potential safety hazards that can cause injury or even death. Help prevent injuries at Christmas and during the holidays by following these tips:

Christmas tree safety begins with the selection and purchase of a fresh tree. When buying a live pre-cut tree, make sure the tree is still alive and healthy. A fresh tree is green, needles are hard to pull from the branches, and when bent between your fingers, needles do not break. Pull on the needles. The trunk should be sticky and the limbs should be very flexible. Lift the tree and bounce the cut end on the ground, if a bunch of needles come tumbling off, it isn’t a safe tree to take home.
When you get the tree home, cut off the bottom two inches of trunk to expose the fresh wood. This will create a fresh, raw cut for the tree to soak in water, allow for better water absorption and helps keep your tree from becoming a fire hazard.
Keep your tree well hydrated. Keep the water in the stand well above the fresh-cut bottom of the trunk.
Christmas trees dry out with heat, so place your tree away from heat sources such as fireplaces or heater vents.
When purchasing an artificial tree, look for the label “Fire Resistant”.
Unplug the lights and decorations when you are not home.
Check each set of tree lights for frayed wires, broken bulbs and loose connections.
Never run electrical cords under the carpets or rugs, over nails or in traffic areas.
Before using lights outdoors, check labels to be sure they have been certified for outdoor use. To hold lights in place, string them through hooks or insulated staples, not nails or tacks. Never pull or tug lights to remove them. Plug all outdoor electric decorations into circuits with ground fault circuit interrupters to avoid potential shocks.
In homes with small children, take special care to avoid decorations that are sharp or breakable, keep trimmings with small removable parts out of the reach of children to avoid the child swallowing or inhaling small pieces, and avoid trimmings that resemble candy or food that may tempt a young child to eat them.
Remember that mistletoe, holly berries and Christmas cactus are poisonous if swallowed.
Use care with “fire salts”, which produce colored flames when thrown on wood fires. They contain heavy metals that can cause intense gastrointestinal irritation and vomiting if eaten.
Do not burn wrapping papers in the fireplace. A flash fire may result as wrappings ignite suddenly and burn intensely.

Holiday Crime Prevention

As the Thanksgiving and Christmas season approaches, the Charleston Police Department wishes to assure you and your neighbors that we are taking measures to combat and prevent the normal increase in criminal activity which occurs this time each year. We also wish to stress the importance of citizens doing their part to protect themselves by not presenting opportunity-criminals with the chance to ruin your holiday.
Additional officers will be on high-visibility patrol around shopping areas, banks, and the like. They will also be available to provide bank escorts for businesses that request them.
A particular problem this time of year is theft from automobiles and residential burglaries. These are the most preventable crimes. If citizens remove the opportunity, the crime is less likely to occur, and some types cannot occur at all.

While Shopping or Going Out:
• Secure valuables out of sight in your trunk. BUT, Be aware that many cars now have fold-down seats or a remote trunk release inside the car. These conveniences make your trunk vulnerable to thieves willing to break a window.
• If at a mall or a shopping center, periodically go to the car and lock away purchases so they will not “disappear” when you put them down trying-on clothes or at the food court.
• Safeguard your purse, wallet, bank cards, and personal information. Identity thieves thrive in this environment.
• Keep close tabs on your children while shopping. With so many people it is easy for them to become lost. Make sure they know their full name, your full name, address, phone, and your cell or pager number to reach you if you get separated.
• Be aware of your surroundings going to your car, going into and out of your house, and while at the ATM.

At Home:
• Make sure to keep doors and windows locked.
• Turn on outside lights at night.
• Report persons or vehicles roaming your neighborhood, day or night so police may check them. They may be simply looking at Christmas lights, or they may be “casing” houses to burglarize.
• Place your tree where the gifts will be less visible from outside. Thieves like window-shopping through your windows.
• After Christmas, don’t put the empty boxes out on the curb. This makes it easy for burglars to decide which houses to burglarize (ie: new computers, TVs, electronics, video games…). Break down boxes and put them in the trash, making sure to save all paperwork. Also remember many electronic devices require original boxes for warranty repair.
• Immediately make an inventory listing the model and serial numbers of new items (and old ones if you haven’t already) and engrave personal markings on them

If Leaving Home (On a trip or just for a little while):
• Make it look like you are still there.
• Timers on exterior lights, interior lights, and TVs will help make it look like you are home. Don’t leave an answering machine message saying you are gone, in fact turning it off would be better.
• Double check all doors and windows, including second floor and basement. The doors should have dead-bolts; key locks for windows are also available.
• Have the neighbor pick up mail, papers, and ads, put out your trash can, and park in your driveway. Give them emergency and cell numbers to reach you.
• Call the police department to request a periodic residence check (“Keep-A-Check”) while you are away. (CPD Dispatch 577-7434)
• When you return, look around outside first. If you see any evidence of a break-in, do not go inside. Go to a neighbor’s house and call police. The burglars could still be inside.

While traveling: THINK SAFETY
• Before you leave, inspect the car for safety (lights, belts and hoses, fluids, wipers, tires-both wear and air – DON’T FORGET TRAILER LIGHTS).
• Pack expensive items in the trunk, or under coverings to keep them out of sight.
• Pack safely. Items stacked in the back of a van, wagon, or SUV will become 60mph missiles in a crash! They also block the driver’s view. Items secured to the roof greatly alter the vehicle’s handling in wind and emergency maneuvers.
• When you stop, take the keys and lock the doors. This applies all of the time, at home and away. An unlocked, running car invites a thief.
• Use a CLUB or other device when parking for the night or at shopping centers Keep doors locked while driving. It adds strength in a collision.
• Use seat-belts and child restraints properly.
• Be careful with bank, gas, and credit cards.
• Take regular rest breaks.
• Never send your children into restrooms alone.
• Store money in separate places to minimize loss or theft.
• Stay on roads you know and take maps, cell phones, and chargers, as well as safety items like blankets, flashlights, jumper cables, a jack, and a good spare tire.
• Drive carefully- better than those around you. You need to get there alive!

Have a wonderful holiday season. Remember, most crimes and accidents are preventable. Officers are working hard to locate and stop crime, but everyone must do their part to lower their risk.

Leasing Guidelines from the Master Deed

ARTICLE 15

LEASING

The Board shall have the power to make and enforce reasonable rules and regulations and to fine, in accordance with the Master Deed and By-Laws, in order to enforce the provisions of this Article.

15.2. Leasing Provisions.

(b) Compliance with Master Deed, BY-Laws, and Regime Rules.

Use of Common Elements and Liability for Assessments.

(iii) Liability for Assessments. When a Unit Owner who is leasing his or her Unit fails to pay any annual special, or specific assessment or any other charge for a period of more than thirty (30) days after it is due and payable, then the delinquent Owner hereby consents to the assignment of any rent received from the lessee during the period of delinquency, and, upon request by the Board, lessee shall pay to the Association all unpaid annual, special, and specific assessments and other charges payable during and prior to the term of the lease and any other period of occupancy by lessee. However, lessee need not make such payments to the Association in excess of, or prior to the due dates for, monthly rental payments unpaid at the time of the Board's request. All such payments made by lessee shall reduce, by the same amount, lessee's obligation to make monthly rental payments to lessor. If lessee fails to comply with the Board's request to pay assessments or other charges, lessee shall pay to the association all amounts authorized under this Master Deed as if lessee were an Owner. The above provision shall not be construed to release the Owner from any obligation, including the obligation for assessments, for which he or she would otherwise be responsible.

(vi) Condition of Leased Premises: Repairs: Use of Leased premises.

(b) In addition to the foregoing, Tenant specifically agrees that the use of the Leased Premises shall conform to the following:

(3) Remedies of the Association. The owner of the Leased Premises and Tenant acknowledge that the Association is a third party beneficiary of the Lease and that the Board shall, after thirty (30) days written notice to the owner of the Leased Premises, have the power to terminate the Lease as if it were the owner of the Unit, or to bring summary proceedings to evict the Tenant in the name of the owner of the Unit in the event of a default by the Tenant in the performance of the terms of the Lease or the Regime Documents and Regime Rules, and the owner of the Unit hereby appoints the Board and its agents as his or her attorney-in-fact to take all such actions that it deems appropriate on his or her behalf. AH costs and attorney's fees incurred by the Regime to evict the Tenant will be assessed against the Unit and the owner thereof.

(4) Landlord Responsible for Assessments. Landlord and Tenant acknowledge that it is the responsibility of the Landlord to pay all fees and assessments charged against the Unit here leased in accordance with the Regime Documents and Regime Rules. In case of nonpayment of assessments or other charges by Landlord, the Association, or its authorized agent, is hereby authorized by Landlord to collect all delinquent assessments and charges directly from Tenant and Tenant is hereby granted by Landlord the right to deduct such amounts paid to the Regime from the rental due Landlord.

(5) Binding Effect. It is mutually understood and agreed that all the covenants and agreements contained herein shall be binding upon and inure to the benefit of their heirs, personal representatives, successors and assign of the Landlord, Tenant, and the Association. Further, the parties agree that all the covenants and agreements contained herein shall be deemed to be part of the lease agreement itself and incorporated entirely within the lease as if included therein originally. Further, the parties agree that, in case of conflict between the lease Agreement and Article 15 of the Master Deed, the provisions of Article 15 of the Master Deed shall prevail. Further, the parties agree that the singular shall include the plural and the male gender include the female, or both male and female, whenever the context shall so require. In the event that two or more persons or entities are listed above as Tenants, the liability of such persons or entities shall be joint and several.

Halloween Safety Tips

TIPS FOR TRICK-OR-TREATERS

§ Carry a flashlight with you for visibility.

§ Always stay in a group with an adult!

§ Never enter a stranger’s house or car for a treat!

§ Always walk on the sidewalk. If there is no sidewalk, walk on the grass away from the street.

§ Look both ways before crossing the street and if you are wearing a mask take it off.

§ Wait until an adult can check your candy before you eat any of it.

§ Only accept treats from neighbors or friends you know!

TIPS FOR PARENTS

§ Plan costumes that are bright and reflective! Consider adding more reflective tape to

costumes + trick or treat bags.

§ Always carry flashlights.

§ Masks can limit or block eyesight, consider makeup or cut the mask eyeholes bigger

so they can see. Remind children to remove their masks to cross the street!

§ We recommend that children do not use props like guns, knives, or swords.

However, if they are used, make sure they don’t look real!

§ Clear hazards from your property. Remove obstacles such as flower pots and garden

hoses, so children won’t trip on them rushing from house to house.

§ Remind your children not to eat the candy until an adult has checked their treats!

§ Your child’s school may be having a Halloween party. Call the School and ask.

§ Please explain to children the difference between tricks and vandalism.

TIPS FOR BUSINESSES/MOTORISTS

§ Heighten your awareness and be cautious of purchases that may have the potential

to cause personal injury or property damage – such as paint ball guns or large quantities of eggs.

§ Drive slowly and cautiously through your neighborhoods. Remember children may not look before crossing the street.

Please report any suspicious activity immediately to the local law enforcement agency. As always in an emergency call 911. Have a Safe and Happy Halloween!

Violation Inspections

The violation inspections will continue to be done on a regular basis. The following is a short list comprised of the most common infractions.

Trash may not be stored in the breezeways or on porches.
Boats, RVs, campers, trailers, etc. may not be stored on the property.
Porches are not to be used for storage. All porches must remain neat and orderly.
Charcoal grills are NOT permitted under any circumstances.
Dogs must be on a leash at all times. Owners must clean up after their pets. Animals may not be left unattended on any balcony or porch.

6. There shall be no obstruction of any common elements. Owners may place small seasonal decorations on their doors. Residents may utilize a 3’x 5’ space in the corridor for a door mat and small decorative items, such as a potted plant, shoe brush, etc.

7. All seasonal, religious and holiday decorations must be removed within 15 days after the conclusion of the holiday.

8. No owner shall keep more than 2 pets in any combination.

9. Owners must provide a copy of the executed lease and tenant information to Community Management Group for all leased units. The minimum lease term in one year.

Door to Door Solicitors

Ref Door to Door solicitors - Alarm salespersons:

We have sent advisories discussing these matters before, and the Crime Prevention unit does advise folks constantly to be suspicious of ANY door-to-door salesmen. The general recommendation of the International and SC Crime Prevention Officers’ Associations is that if you are interested in an alarm system, rather than opening your door to a stranger, you yourself call and initiate appointments with at least 3 different companies that you select from the phone book. Compare the estimates and pick the service that fits your needs. It is just the philosophy that you are safer in an encounter you arrange than taking a chance on a solicitor.

The Business License office states that there is a properly authorized group of ADT staff issued Peddlers Permits working right now.

It is apparently a common practice in the alarm business to react to media coverage and crime reports, using them as a guide of areas to go to, to try to make sales. If you answer your door, ask to see their City Peddler’s Permit. They are required to have this permit on-hand. The person ringing your doorbell is likely to be legitimately associated with a large corporate or small local system, or may be a private contractor attached to the large company. But they may also be independent fly-by-night-never-see-them-again types or outright criminals casing the neighborhood. It can be difficult to tell. It would be possible to pretend to be associated with a known company, making up things with fake logos, but they rarely go through the proper channels of the Business License office. The bottom line is that if the person doesn’t have an actual City of Charleston PEDDLER’s PERMIT IN HAND (see attached picture), they are breaking the law to begin with, and should be told to leave. When they do leave, call police to have them checked out for possible citations and further investigation, giving their physical and clothing descriptions, vehicle descriptions and last known travel direction.

Regarding the question of signage, according to a Supreme Court ruling, a “No Soliciting” sign at the front of a neighborhood is enforceable ONLY if the neighborhood is all private property, including private roadways (not public streets under city, county, or state maintenance) like a gated community. Beyond that your defenses are a “No Soliciting” sign posted on each home combined with laws/ordinances requiring permitting. Violation of the ordinances in the City can potentially be a ticket/fine of several hundred dollars for each type of offense and each house they bothered.

I will also mention that some residents’ practice is to refuse to answer the door for strangers, and that is good. However, I would advise that residents do call out and say they are not interested, so it is known that there is someone home. After they leave call the police as stated above. I say this because in a few incidents where residents kept quiet, a few minutes later the thief attempted to break-in through the back door, thinking no one was home.

Clubhouse Security

More work is being done to increase security at the clubhouse. Red flashing lights have been installed to alert residents of the clubhouse closing time. The lights are set on a timer to flash for a brief period at 9:45 again at 9:55 and finally at 10pm. This should give occupants plenty of time to evacuate the building prior to the 10pm closing time.

An additional camera is being installed to get a better view of the clubhouse’s main room. The camera is an infrared camera so it will be easier to see activity even if the room is not lit.

Timers are being installed to auto shut off the media at 10pm.

Crime Prevention

Recently there have been reports of suspicious behavior around the community. Specifically, some residents have reported that expected packages are not being delivered to their units. Last Friday, a young man was caught with a package that did not belong to him. He was confronted and the police were called. The package was finger printed, but the resident disappeared before the police arrived. A report has been filed. If you see any suspicious behavior, don’t hesitate to call the Mt. Pleasant Police Department (884-4176). They are actively patrolling the community, but need your help to catch the suspected culprit.

Below are some crime prevention tips from the Mt. Pleasant Police Department:

Protect yourself, protect your neighborhood!

NEIGHBORHOOD CRIME PREVENTION TIPS

• Lock your vehicle. A large percentage of automobile break-ins involve unsecured vehicles.

• Never leave valuables inside of the vehicle, where they can be seen in plain view.

• Trim back any shrubbery that hides the doors or windows of your house.

• Illuminate your yards and entranceways. Consider using motion-detection lighting.

• Never open your door to anyone that you do not know.

• Keep your doors locked whether you are at home or away.

• Keep your garage door closed and locked, even when at home or in the backyard.

• Half of all home burglaries occur during the day. Be alert to any suspicious persons or vehicles in the area. If anything seems out of place, notify the police to check it out.

• Be observant of repair men, construction workers or service workers, who might be thieves. If their behavior or location seems out of the ordinary, notify the police.

• Consider investing in an alarm system. Receive at least three different estimates.

• Get to know your immediate neighbors. Be familiar with what type of vehicles they drive, whether they have out of town guests, or if they will be having hired services performed at their homes. This can be one of the best ways to deter crime.

Advisory Committee Updates

The Advisory Committee met on August 10^th to follow up on the previously noted concerns.

Compactor-The new sign seems to be working fairly well. The area seems to remain free of piles of garbage.

Entrance Gates-In September of 2009 a resident ran into and damaged the gate. The incident was caught on tape. However, the resident was unresponsive to any correspondence from Community Management Group requesting payment for the cost of the repairs. The Board of Directors hired an attorney to pursue the monies. The case was heard on August 6^th and the Association won. The defendant is responsible for paying damages, attorney’s fees and court costs.

Annual Meeting-The committee decided to suggest the date for the annual meeting at the next committee meeting. The suggested meeting date will be sent to the Board of Directors for consideration.

Cleaning Your AC Condensate Drain

The most common method of cleaning, is to gain access to your drain line... whether that is within a cleanout or from inside the evaporator coil drain pan, and simply flush the line with either compressed air or a water hose, forcing everything from the inside to outside. (Never flush water from outside the home, to the inside of the unit, a mess will occur!)

If you don't have access to an open end of the drain from inside, you may need to disconnect or cut the drain line to perform the cleaning. This should be done at least once every year and more often in areas where you use air conditioning more than 6 months of the year! Doing so will prevent the AC drain from leaking water into the home!

AC Drain Clean Out

If your home is equipped with a central air conditioning system you may have noticed a drain line on the outside dripping water near the air conditioner. This line drains condensation from the inside air handler to the outside. If this line clogs (usually from algae) it can cause water damage inside the house.

You can prevent a clog by simply pouring a cup of household bleach into the line from the inside. To remove a clog once it has occurred, attach a wet/dry vacuum to the drain line outside (removing the paper filter first) and suck the clog out.

ADVISORY COMMITTEE MEETING

MINUTES

July 27, 2010

The first meeting of the Advisory Committee of The Battery at Park West was held on Tuesday, July 27, 2010, at the Battery’s Clubhouse. Committee members in attendance were Karen Martin, Jackie Savino and Ed Fitzpatrick. Community Management Group was represented by Jennifer Seabrook and Steve Peck.

I. CALL TO ORDER

The meeting began at 6:39pm.

II. PURPOSE OF THE COMMITTEE

1) The Advisory Committee shall be advisory to the Board of Directors on governing issues affecting the maintenance of Common Areas for the Association and recommend appropriate changes and modifications as needed; 2) The Advisory Committee will review the Rules and Regulations for the Association and recommend appropriate changes and modifications as needed; 3) The Advisory Committee shall have no power or authority to act on behalf of the Board of Directors of the Association; 4) The Advisory Committee shall keep minutes of all meetings; 5) The Advisory Committee will submit a written report of its recommendations and announcements to the Board of Directors prior to each regular meeting of the Board of Directors.

III. COMMITTEE MEMBERS

The members of the committee are Ed Fitzpatrick, Karen Martin, Linda Dolton, Justin Sawyer and Jackie Savino.

IV. NEW BUSINESS

The main purpose of the initial meeting was to establish a comprehensive list of the outstanding issues that homeowners are concerned with. This information will be brought to the Board of Directors for consideration.

Gates-The Committee would like to see the gates closed throughout the entire day rather than just in the evening hours. It was discussed that if the gates were set to be closed all day and night, the repair costs will likely increase substantially. The probability of damage would be significantly higher due to the amount of traffic that comes and goes during regular daytime hours. Additionally, the added strain on the gates from opening and closing all day would decrease the life span of the gate system. It was suggested that an arm could be installed for daytime use as the repair costs for the arms is much more affordable than the repair costs of the main gate.

Compactor-The build up of trash and bulk items around the compactor is still an issue although has been greatly reduced over the last few weeks. One of the main reasons the compactor doesn’t cycle through is the red emergency stop button that gets pushed in. It was suggested that a wooden sign be posted at the base of the stairs explaining to residents that if the compactor is not working pull the red button. Another sign could be posted at the front of the compactor stating that bulk items cannot be left at the compactor area.

Leaks-A few owners have recently been experiencing leaks in their units. The two cases that Community Management Group was notified of both involved clogged lines associated with the AC units. A clogged line can produce 5-10 gallons of overflow water per day. It is extremely important that owners have their units serviced at least once per year. The filters should be changed every month. The HVAC system is the maintenance responsibility of the individual owners. The Association is not responsible for any leaks that are a result of the HVAC system.

Janitorial-It was noted that there has been a visible improvement with the cleaning of the buildings. A new janitorial company was hired a few months ago to be on site Monday through Friday from 9am to 5pm. The new company has been doing a good job of keeping the breezeways free of debris, cleaning the elevators and picking up trash around compactor area.

Pressure Washing-The Committee inquired about pressure washing for the exterior of the buildings as well as the breezeways. Ms. Seabrook informed them that the pressure washing has already been scheduled for the end of August. The exterior, breezeways, stairwells and compactor area will all be included.

Landscaping-It was noted that there have been significant improvements in the landscaping services. Ms. Seabrook mentioned that she has been conducting regular walkthroughs with the landscape contractor. Community Management Group also hired a horticulturalist who visits the property regularly to note any deficiencies and offer suggestions.

Umbrellas-Some owners have expressed irritation with the lack of umbrellas at the pool. The reason the umbrellas have not been replaced is because the pool area is not monitored on a regular basis. The umbrellas that were placed around the deck previously were all damaged during wind storms. There aren’t any volunteers willing to close the umbrellas before a storm so they end up getting broken from the force of the wind. It doesn’t make sense to continue to replace the umbrellas if they’re going to end up in the pond like the original ones.

Commercial Vehicles-Commercial vehicles are only permitted on property while they are providing a service. Community Management Group will tag commercial vehicles as they are reported.

Clubhouse Security-There continues to be misuse of the clubhouse on a regular basis. The Association has taken several measures to curb the disruptive behavior over the last two years. These include increasing the number of cameras and providing online access, installing locks on all of the windows, installing a security system that arms itself at 10:30pm and assigning all of the key fobs to individual units to identify who is entering the building. Even with all of these upgrades there is still a need for additional security. It was suggested that a security guard be placed at random nights in the clubhouse over the next few weeks. The cost is $25.00 per hour to hire an off duty police officer. Another suggestion is to install breaker bars on all of the access doors.

Leases-There is concern regarding the short term rentals that seem to be prevalent throughout the community. Community Management Group will contact owners of units that are reported to have a move in or move out to inquire as to the status of the unit. The Master Deed requires that a one year lease be provided. The Board of Directors has agreed to waive the $1,000.00 security deposit for owners who comply with the leasing requirements. However, those unit owners who do not provide the appropriate documentation will be subject to the security deposit as well as fines for being in violation of the Master Deed. Owners should contact Community Management Group when they become aware of a resident moving in or out.

Delinquent Accounts-There is currently a significant amount of delinquencies on the books. The collection process is as follows:

If the monthly assessment is not received by the 5^th of the month that it is due, the owner will receive a late statement noting the past due amount. If the account remains delinquent the following month, a late statement and a letter is mailed to the owner. The letter states that the account is over 30 days past due. This process is continued for the 60 and 90 day period. If after the 90 day letter and late statement are mailed the account is not paid in full, a lien will be filed against the unit. Once the lien is returned from Charleston County the owner is mailed a copy of the filed lien along with a letter that lets them know that if the account is not paid the Board will refer the account to the Association’s attorney for further collection action which will result in significant legal fees. Once the attorney receives the account they will send a demand letter to the unit owner. If the account is not brought current the attorney will pursue a foreclosure on the lien. However, if at anytime during this process the mortgage holder foreclosures on the property the debt is cleared and must be written off. In these cases, the Association will pursue a personal judgment in small claims court. The judgment is attached to the individual’s credit. Although the judgment may be awarded, this does not mean the money will be collected.

Budget-The Association works on a balanced budget. This means that the exact amount of money that is required to cover all the anticipated expenses is the amount that is billed to the owners. When units are foreclosed on and the delinquent assessments are uncollectible there becomes a deficiency in the budget. The Association runs the risk of not being able to afford the previously budgeted items without an increase in assessments

As you may have noticed there has been an abundance of trash accumulating at the compactor over the last several weeks. As we have seen this in the past, it has increased in frequency lately. There are ways we can help prevent this eyesore. See below.

§ If there is trash on the stoop, don’t just assume the compactor is broken. This may have just been a lazy resident who didn’t want to get out of their car so they threw the garbage on the top of the stairs.

§ If the compactor really isn’t working, pull the red emergency stop button that is located just inside the window opening on the right side. Many times this stop button gets pushed in and that is the only issue. Once the stop button is pulled out the compactor will function normally.

§ If you witness ANYONE leaving bulk items or regular trash in or around the compactor get as much information as you can (vehicle information, tag number, physical description of culprit, etc.) and report them to Community Management Group.

Please help us keep the entrance looking beautiful. Nobody wants to pull in or out of their community and see huge piles of trash piled up. The aesthetic reasons alone are enough, but there are also health issues related to exposed trash that can be avoided.

Over the last two weeks the compactor has become a major eyesore with residents leaving bags of trash and bulk items sitting in front and around the compactor. This area is one of the first to be seen as you enter the community. If you see someone leaving trash around the compactor, please report it to Community Management Group. If you can’t identify the individual a vehicle description and tag number will allow us to find the culprit. Everyone in the community need to be involved in putting this behavior to an end and your help is truly appreciated.

Running for the Board-Do I Have What it Takes?

If you’re considering running for the board, we ask that you take a few moments to ask yourself the following three questions:

Do I have the time?: As a board member, you will need to devote at least several hours of your time each month to association business. In addition to regular monthly board meetings, you will need to be active in email discussions and occasional special meetings. During special projects, you may need to spend a little extra time on association business. Some board members may also spend a little more time than others if they work with a committee

Can I make tough decisions when it’s required?: The primary role of the board is to conduct the business of the association. This doesn’t just mean approving the budget, but also developing and enforcing policies. Board members are required to step outside their immediate circle of family and neighbors and make decisions based on the greater good of the community.

Can I do all this and have fun, too?: It isn’t all about policies and tough decisions. Our community is only as good as we make it, and establishing and maintaining a sense of community is a part of a board member’s responsibility. Planning and attending functions such as our picnics and being a presence in the community are as important as any policy decisions you may make.

Being a board member can be frustrating at times, but it may also be one of the most rewarding ways you’ll find to volunteer your time. If you’re interested in running for the board or would like more details about board’s responsibilities, please contact the manager or a current board member.

Assessments

Association members who pay their assessments late or not at all come up with some very interesting excuses. Here’s half a dozen of the most common, and why it’s smart not to use them.

Excuse #1: “I didn’t get what I paid for.”

“My building hasn’t been painted in five years! I’m not paying another cent until some basic maintenance gets done.”

“The power was out for three days during the storm. I’m withholding a pro-rated amount from my assessment check.”

You have a right to require the association to perform its duties, and various legal channels exist to accomplish this. Withholding assessments is not one of them. Your obligation to pay assessments has nothing to do with the association’s obligations to provide maintenance and service. If you withhold your check or pay a reduced amount, you’ll become delinquent, and that leads to late fees, and actually makes your situation worse.

Excuse #2: “You didn’t bill me.”

“I didn’t get an invoice.”

“You didn’t tell me I was behind in my payments.”

Many association governing documents neither require the association to send invoices nor provide advance notice of payments due or past due. However, associations are required to send the approved budget to each owner annually and we do just that. When the association approves and sends the budget each year to our members, it contains notice of the amount you must pay annually. If you’re ever unsure about the amount or the due dates, just call the management office.

Excuse #3: “You can’t do that!”

“These people have no right to make me pay for neighborhood upkeep.”

“If they think I’m paying those outrageous late fees and interest, they’re crazy.”

Actually, the association not only has the authority, it has a duty to all owners to collect assessments. This authority is established in the governing documents and the state’s common interest ownership statutes. When you moved into a community association, you agreed to abide by those documents—and that includes paying assessments.

Excuse #4: “I never use the recreational facilities.”

“I don’t play golf, and it’s an expensive game. I shouldn’t have to pay to maintain the course.”

“I’ve never been in the fitness center, and I don’t plan to ever use it. Why can’t you pro-rate my assessments accordingly?”

Admittedly, recreational facilities are expensive to operate and—for some associations—represent a good chunk of the budget. Nevertheless, most declarations specify that even if you don’t use the association’s amenities you’re still obligated to pay for their upkeep.

Many of our residents moved into this community specifically for the recreational amenities; they’re willing to pay for them because they take full advantage of the opportunities they provide. Even if you’re not using some of the amenities, they make the community more desirable and the homes in the community more valuable. If you’re not using the facilities, perhaps you should consider whether this community is the best fit for you and your needs.

Excuse #5: “I paid in full.”

Sometimes the association receives a check that says “paid in full” in the memo section—but it isn’t. Or the check will arrive with a letter or note, stating the check is “payment in full,” or it covers all charges through a certain date. Nice try. If you still have an outstanding balance, we’re not going to cash your check. We’re going to return it to you. This will put you further behind in your payments and just cause more late fees.

Excuse #6: “The fees are too high.”

Assessments reflect the actual cost of maintaining all common elements in the community. If you owned your home outside the association, you would have to pay individually for all the same expenses your assessments cover—trash removal, water, landscaping, and so on. In fact, you’re actually spending less on assessments because the association has bulk buying power, and you’re getting more because the common areas provide amenities that you likely could not afford on your own.

Legitimate Reasons, not Excuses

When association members lose their jobs or become injured or ill, the association board understands that arrangements need to be worked out for paying assessments. If you have a legitimate reason for falling behind and you need to work out a payment plan, please call the manager. The board considers each situation individually, and will to try to accommodate you special circumstances.

Key Fob System

Recently, the fob system crashed. During this time many residents were unable to access the clubhouse and the pool area. Community Management Group tried to reset the system remotely and reset the system at the main computer on site. However, neither of these attempts were successful. A professional IT person was called to investigate and make the necessary repairs. He was able to do so within a couple of days. It was reported that the cause of the malfunction had to do with the automatic Microsoft updates. These updates are no longer necessary and will be blocked. We should not experience this same issue in the future.

County Expands Recycling Program to Accept Cardboard at Curbside

Charleston County will begin picking up corrugated cardboard and more paper items during its normal curbside recycling routes

During last Saturday’s 11^th Annual Earth Day Festival, Charleston County Council member Colleen Condon announced that Charleston County’s Environmental Management Department has expanded its recycling program to accept corrugated cardboard as part of its residential curbside recycling program. Corrugated cardboard is considered cardboard boxes with a middle “waffle-like” layer.

In addition to cardboard, the County is now also accepting all paper items to include envelopes with plastic windows, gift wrapping paper, etc.

“We are excited to announce that Charleston County now accepts cardboard and all types of paper in our curbside bins and drop sites,” Condon said. “If you can tear it, recycle it in your bin.”

In honor of Earth Day, the County has compost on sale for the month of April at the Bees Ferry Landfill for $1 per bag or $5 per ton, which is half off the regular price.

How to recycle cardboard:

Residents with curbside service can now place cardboard at the curb with their regular recyclables that are placed in one bin for plastic bottles, glass bottles, aluminum cans, steel cans and aerosol cans, and in another bin for paper, such as magazines, newspaper, junk mail, paperboard (examples: cereal boxes, tissue boxes, etc.) and office paper.
Curbside residents should flatten and place cardboard boxes, up to three feet by three feet in size, between or under their two bins or inside a separate bin. Curbside recycling in Charleston County is collected bi-weekly in the urban areas starting at 7 a.m.
Rural residents, as well as curbside users who have cardboard pieces larger than three feet by three feet, can drop their cardboard off at the drop site locations and County staffed Convenience Centers. Charleston County Environmental Management maintains 40 cardboard drop sites and eight Convenience Centers located throughout the County.
Residents in the rural parts of the County can utilize drop sites and Convenience Centers for recycling services. Drop site locations are open 24 hours per day and seven days a week and are not staffed. Convenience Centers are staffed by Environmental Management Department employees.

Now that the weather has warmed more residents will be enjoying the outdoors with their pets. As a reminder, the Battery has a great dog wash station in the large field near the 1100 building. When spending time with your pets outside, it is important to remember to pick up after them. We see a lot of pet waste in the field near the dog wash station. Although it is a great place to exercise your pets it is also intended for human use. It is difficult for anyone to play in an area covered in pet waste so please make a conscious effort to respect your neighbors and pick up after your pets.

Crime Prevention-What is suspicious activity?

WHAT IS SUSPICOUS ACTIVITY?

Basically, anything that seems slightly “out of place” could be criminal activity and should be considered suspicious activity. Some of the obvious things to watch for are:

1. A scream heard anywhere may mean a crime is being committed.
2. Offers of merchandise or repair work at ridiculously low prices, could mean stolen property or some type of fraud.
3. Anyone seen peering into parked vehicles may be looking for a car to steal or for valuables inside of the car.
4. Someone attempting to enter a vehicle using a device other than a key. Also, anyone seen tampering with a door handle, trunk, or
hood.
5. An improperly parked vehicle, abandoned vehicle, or someone leaving one vehicle and driving away in another.
6. A clean car with damaged license tags.
7. Any vehicle moving slowly, without lights, or without any apparent destination. This vehicle may be “casing” the neighborhood to commit a burglary or robbery, the driver may be a drug dealer, or
the driver may be sex offender.
8. Anyone being forced into a vehicle.
9. Someone trying to open a neighbor’s door or window.
10. A stranger inspecting or entering your neighbor’s home while they are away.
11. A moving truck or van pulled up to a neighbor’s house while they are gone.
12. Someone carrying property such as TV’s, stereos, etc.
13. Someone running from a home or vehicle.
14. The sound of breaking glass could mean an accident, burglary, or vandalism.
15. Persons loitering.
16. Business transactions conducted from vehicles. Or a steady flow of strangers to and from a particular house.
18. Individuals soliciting door to door without a proper permit and identification.
19. Persons around the neighborhood who do not live in the neighborhood could be burglars.
20. A stranger offering a child candy or some other gift.
21. A person exhibiting unusual mental or physical symptoms may be injured, under the influence of drugs or alcohol, or in need of psychiatric assistance.
22. Someone carrying a weapon.

If these or other suspicious situations should occur, notify the police to investigate it further. Although there may be numerous non-criminal explanations for suspicious situations, law enforcement would prefer that it at least be checked out. Do not hesitate to call.

National Association of Letter Carriers Food Drive occurs every year on Mother’s Day weekend. This is the nation’s largest one-day effort to help needy families. All of the food that is collected, last year it was 100,000 pounds, comes to the Lowcountry Food Bank. It’s so easy to donate. Clubhouse Hours and Security

The new clubhouse hours are from 6am until 10pm effective immediately.

An alarm has been installed as you may have seen with the Sonitrol signs that have been placed around the perimeter. Motion sensors have been installed inside and will set off a silent alarm that will notify the proper authorities if there is movement in the clubhouse after the designated times. Please remember that it is considered trespassing to be in the clubhouse during the the hours that it is closed and violators will be prosecuted at the highest possible level.

These new monitoring features are another one of the constant efforts that the Board has put forth to minimize the amount of vandalism and disregard for HOA property that has been evident these past few years. It is the Boards hope that these new security features will put a stop to the late night intruders and we can once again replace all of the broken equipment (i.e. pool sticks) so that our residents can enjoy the clubhouse as it was meant to be enjoyed.

Termite Stations

Mr. Ray Wrenn has generously decided to give an entrance gate remote to all owners who complete the previously mailed information form. With the remote, it will no longer be necessary to stop and enter a personal code at the punch key box.

The gate remotes will only be issued to owners who are current in their assessments and have provided all of the necessary contact, vehicle and pet information. If a unit is rented, a copy of the current lease should be submitted as well as the contact, vehicle and pet information of the current residents. The gate remotes will not be released to the tenant without written permission from the owner. Gate remotes will be specifically attached to each unit and therefore will be used in identification purposes if necessary.

The gate remotes will be available for pickup at the Clubhouse on Friday, January 8, 2010 from 1:00pm – 7:00pm. As an owner, if you would like to purchase a second remote they will be at a charge of $50.00. There will be a maximum of two remotes assigned to each unit.

Surveillance Cameras

The surveillance cameras have been a very successful tool in catching bad behavior at the Battery at Park West. To date we have identified the culprit who badly damaged the entrance gate. We have also successfully identified more than five units whose occupants were abusing the clubhouse rules and regulations. These individuals are being fined for this behavior and the disregard for Association property. Other enhancements that have been a great tool in identifying these individuals is the key fob report. We are able to match the key fob used to enter the clubhouse or pool area to each unit. In the past, some of the kids accessing the clubhouse were doing so through the windows. We have added another security feature that has put a stop to that as well. With all of the new additions it is very difficult for anyone to get away with disregarding the clubhouse rules. The Board is hopeful that these incidences will cease now that everyone is being held accountable.

Gate damage

We have experienced several incidences with the gate being pushed open and damaged. A code is required to enter the community. All residents and owners were notified of this change in a mailing sent out several weeks ago. Additionally, there is a sing by the punch code stand that has a number to call if you do not have your code. This will give you a temporary code to enter at that time. You will need to contact the office during regular business hours to reestablish a permanent code for your unit.

The gate is locked in the evenings requiring a code to enter. If you have not done so, please confirm that your code is working properly. If you do not know your code, please call the office so a new entrance number can be assigned to your unit. The landscaping has been a major concern for many residents. The Board is reviewing several bids from other companies as well as a revised proposal from the current vendor. Key Fob

As some of you may already know, there have been some problems with the key fobs. As we are working to upgrade the security at the clubhouse and pool area the fob system has been modified. Some fobs have been affected by this upgrade and we are working deli gently to get this resolved. If you are experiencing any difficulties with your fob, please contact our office at 795-8484.

Guidelines for Community Living-A compilation of the Association’s guidelines including rules and regulations, maintenance responsibilities, violations processes, collection processes, etc was put together in a booklet form that will be mailed to owners this week. This document will also be available on the website at www.cmgcharleston.com/bpw.htm. If you have tenants occupying your unit, please ensure that we are made aware so we can mail a copy to them as well. The goal is to get as much information to as many residents as possible in an effort to reduce the number of violations and keep the community looking great.

Building Representatives-In an effort to better monitor the community we are asking for volunteers to serve on a building representative committee. The role of a building representative is to notify management of any maintenance issues, violations, move-ins, concerns, etc. Since we are not on site everyday, the building representative will serve as the eyes and ears of their building. This will help to identify new tenants so that we may provide them with the community guidelines, catch maintenance issues in a timely manner and address any concerns immediately. If you are interested, please contact me directly.

Transition-The Association will be transitioning from developer control to the homeowners over the next few months. If you are an owner in good standing and are interested in serving on the Board of Director’s, please let me know.

Gate Code-The entrance gate will be locked in the evenings and a code will be required. If you do not know your code or would like to change an existing code, please contact our office immediately. The closure will go into effect next week. You will no longer be able to pull up close to the gate and have it open automatically.

Clubhouse-In an effort to help reduce the electric bill we ask that you do not leave the garage door open when the air conditioning is running. Please turn off all media equipment, lights and stereo if you are the last to leave.

The website will issue a password that will be emailed to you usually within 24 hours. Once you’ve received the password you will be able to safely pay your assessments online, create, modify and view recurring payments and review your account transaction history in real time.

Clubhouse Hours

The Battery has one of the nicest amenity centers in Charleston. In an effort to keep it looking great the Board has decided to limit the access hours. Beginning on May 15th the Clubhouse hours will be from 5:00am until 11:00pm. Keyfobs will not be activated during the hours that the clubhouse is closed. Anyone entering the clubhouse or pool area after hours will be considered trespassing. The purpose of the limited hours is to reduce vandalism which has historically occurred after 11pm.

Guidelines for Community Living

We have been working very closely with the Board of Directors to come up with specific community living guidelines for The Battery. These guidelines, which will be sent to all homeowners within the next few weeks, will include topics such as general use restrictions as stated in the Master Deed, Clubhouse rules and reservation procedures, violation policies and maintenance request procedures among other items. Violations will be enforced on a regular basis so I encourage all owners to forward this forthcoming information to their tenants to avoid any infractions and subsequent fines. The goal of this document is to inform everyone of the community wide expectations and to keep The Battery at its absolute best.

Pool Opening

Now that the pool is ready for use we encourage you to review the full set of rules. If you need an updated copy, please contact me and I’ll be happy to get those to you. Below are a couple of important reminders.

The pool hours are from dawn to dusk. Anyone in the pool beyond these times will be considered trespassing.
The restrooms are to be accessed through the side door, especially when wet.
Pets are not allowed in the pool area.
Glass products of ALL kinds are strictly prohibited in the pool area (even when covered by a koozie).
Anyone under the age of 16 must be accompanied by an adult at ALL times.

Roundtable Meeting Highlights

Board of Directors-The Declarant stepped down as President of the Association and nominated two Board members. Ernie Harrington will serve as President and Hampton Lee will serve as Treasurer.

Contact Person-Jennifer Seabrook is the Association Manager for The Battery at Park West.

Budget-The budget was approved prior to the 2009 billing. Community Management Group has reviewed the budget and determined that it has already been squeezed down as much as possible for this year.

Entrance Gate-The entrance gate will be locked in the evenings. Everyone will need a code to enter. Ms. Seabrook will send out a notice to all owners prior to this taking effect.

Clubhouse Hours-The Clubhouse hours will be from 5:00am until 11:00pm at which time all the doors will lock. Your key fob will not allow entrance into the building during the times the clubhouse is closed. This will go into effect after a notice is sent out to the owners.

Bicycle Racks-The Board will look into purchasing bicycle racks to be placed strategically throughout the community.

Hammocks-The hammocks were removed because they proved to be a liability to the Association. Two people reportedly fell from them. Although they were not seriously hurt, the Board feels that the liability is too great.
